Tubento Terms of Service

Please read these terms carefully before using the Service.
Interpretation and Definitions
Definitions
Company ("the Company", "We", "Us" or "Our") refers to Twillot, the operator of Tubento.
Country refers to: Hong Kong SAR China.
Service refers to the Tubento website at https://tubento.app and the browser extensions published under the Tubento name.
Terms mean these Terms of Service, which form the entire agreement between You and the Company regarding the use of the Service.
Third-party Service means any service or content provided by a third party, including YouTube, that may be displayed or affected by the Service.
You means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is acting.
Acknowledgment
These Terms govern the use of the Service and the agreement between You and the Company. By accessing or using the Service You agree to be bound by these Terms. If You disagree with any part of these Terms You may not use the Service.
Age Requirement: You represent that you are over the age of 18, or the age of majority in Your jurisdiction, and are able to form a binding contract.
Your use of the Service is also conditioned on Your acceptance of Our Privacy Policy, which describes how We handle information when You use the Service.
Nature of the Service and Third-party Platforms
The Service changes how pages of third-party platforms, in particular YouTube, behave inside Your browser. The Service is not affiliated with, endorsed by or sponsored by YouTube or Google. Third-party platforms may change at any time and such changes can make parts of the Service stop working without notice.
You are solely responsible for ensuring that Your use of the Service complies with the terms of service of any third-party platform You use it on. You acknowledge that some platforms restrict or penalise the use of ad blockers or similar tools, and that any consequences from such use, including degraded playback or account restrictions, are Yours to bear.
Licence and Acceptable Use
Subject to these Terms, We grant You a personal, non-exclusive, non-transferable, revocable licence to install and use the Service for Your own purposes. You may not reverse engineer, redistribute, resell or sublicense the Service, remove any notices from it, use it to interfere with the rights of others, or use it in any way that violates applicable law.
Accounts, Waitlist and Communications
The Service does not currently require an account. If You join the waitlist You agree to receive a small number of emails about the features You asked about. You may opt out at any time.
Payment Processing
The Service is currently free. If paid plans are introduced, payments will be processed by Paddle as Merchant of Record, meaning You purchase from Paddle, who is authorised to sell Our products on Our behalf. Refunds for any paid plan are governed by Our Refund Policy.
Links to Other Websites
The Service may contain links to third-party websites or services that are not owned or controlled by the Company. We have no control over, and assume no responsibility for, the content, privacy policies or practices of any third-party websites or services.
Termination
We may terminate or suspend Your access immediately, without prior notice or liability, for any reason, including if You breach these Terms. Upon termination Your right to use the Service ceases immediately. You may stop using the Service at any time by uninstalling the extensions.
Limitation of Liability
Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of these Terms and Your exclusive remedy shall be limited to the amount actually paid by You through the Service, or 10 USD if You have not paid anything.
To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect or consequential damages whatsoever (including loss of profits, loss of data, business interruption, personal injury or loss of privacy) arising out of or related to the use of or inability to use the Service, even if advised of the possibility of such damages.
"AS IS" and "AS AVAILABLE" Disclaimer
The Service is provided "AS IS" and "AS AVAILABLE" with all faults and defects, without warranty of any kind. To the maximum extent permitted by law, the Company expressly disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement, and makes no warranty that the Service will meet Your requirements, operate without interruption, or continue to work with any third-party platform.
Governing Law
The laws of the Country, excluding its conflicts of law rules, govern these Terms and Your use of the Service. Your use of the Service may also be subject to other local, national or international laws.
Disputes Resolution
If You have any concern or dispute about the Service, You agree to first try to resolve it informally by contacting the Company.
For European Union (EU) Users
If You are a European Union consumer, You will benefit from any mandatory provisions of the law of the country in which You are resident.
Changes to These Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days' notice. By continuing to use the Service after revisions become effective You agree to be bound by the revised Terms.
